Overview
This document applies to all cybersecurity software-as-a-service solutions, websites, applications, platforms, APIs, software, modules, features, documentation, support, and related services made available by Stack4Sec, LLC, a Wyoming limited liability company.
For purposes of this document, "Stack4Sec," "Company," "we," "us," and "our" mean Stack4Sec, LLC. "Customer," "you," and "your" mean the person or entity accessing or using the Services.
This document is incorporated into and forms part of the Stack4Sec Terms of Service. Product-specific terms may supplement this document for particular products, modules, services, or features.
This document explains how Stack4Sec approaches Australia's Privacy Act 1988 and the Australian Privacy Principles (APPs). It is provided for transparency and does not constitute legal advice.
Scope
This document applies where Stack4Sec processes personal information subject to Australia's Privacy Act 1988 or the Australian Privacy Principles in connection with the Services.
Roles and Responsibilities
Depending on the processing activity, Stack4Sec may handle personal information for its own business operations or on behalf of a Customer. Customer is responsible for determining whether it is an APP entity and for complying with obligations applicable to Customer's collection, use, disclosure, retention, and security of personal information submitted to the Services.
Collection of Personal Information
Stack4Sec collects personal information reasonably necessary for the Services and business operations, including account information, business contact information, usage data, support communications, billing information, and Customer Content submitted by Customer.
Customer is responsible for ensuring that personal information submitted to the Services is collected lawfully and fairly and that required notices or consents have been provided or obtained.
Use and Disclosure
Stack4Sec may use and disclose personal information to provide, secure, support, maintain, improve, and administer the Services; manage accounts and billing; communicate with users; prevent fraud and security incidents; comply with law; enforce agreements; and fulfill other purposes described in the Privacy Policy.
Stack4Sec may disclose personal information to service providers, subprocessors, vendors, professional advisors, authorities, and transaction parties as described in the Privacy Policy and applicable agreements.
Cross-Border Disclosure
Stack4Sec is based in the United States and may disclose or transfer personal information to recipients in the United States and other countries. Where the Privacy Act applies, Customer is responsible for determining whether APP 8 or related cross-border disclosure requirements apply to Customer's use of the Services.
Stack4Sec uses contractual, technical, and organizational safeguards designed to protect personal information processed in connection with the Services.
Access and Correction
Individuals may have rights to request access to and correction of personal information under the Privacy Act. Requests may be sent to contact@stack4sec.com. Where Stack4Sec processes personal information on behalf of Customer, Stack4Sec may refer the request to Customer or assist Customer as required by the applicable agreement.
Security of Personal Information
Stack4Sec implements commercially reasonable safeguards designed to protect personal information from misuse, interference, loss, unauthorized access, modification, and disclosure. Customer is responsible for security measures under its control, including account configuration, access rights, device security, data minimization, and external sharing.
Retention and Deletion
Stack4Sec retains personal information for as long as reasonably necessary for the purposes described in the Privacy Policy, the Agreement, and applicable law. Customer is responsible for deleting or exporting Customer Content where the Services provide such functionality and for determining its own retention requirements.
Direct Marketing
Stack4Sec may send marketing communications where permitted by law. Recipients may opt out using unsubscribe mechanisms or by contacting Stack4Sec. Transactional, administrative, legal, security, and service communications may continue.
Notifiable Data Breaches
If Stack4Sec confirms a Security Incident affecting Customer Personal Data, Stack4Sec will notify Customer in accordance with the Data Processing Addendum and applicable law. Customer is responsible for determining whether a notification to individuals or the Office of the Australian Information Commissioner is required.
Complaints
Privacy complaints may be sent to contact@stack4sec.com. Stack4Sec will review complaints and respond as appropriate. Individuals may also have rights to contact the Office of the Australian Information Commissioner.
